11-06-2019 Heard Sri Brij Nandan Prasad, learned counsel for the petitioner and Sri Dilip Kumar No.1, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 22-02-2018, as stated in paragraph - 7 of the petition, in Belhar (Khesar) P.S. Case No. 220 of 2017 registered for offence under Section 379 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that F.I.R. was lodged against unknown and since petitioner was accused in other cases, he was implicated in the present case. Learned Addl. Public Prosecutor has opposed the prayer for bail.

No.29454 of 2019(3) dt.11-06-2019 2/2 However, considering the nature of accusation as well as period of custody, let the petitioner namely Niranjan Yadav @ Niranjan Kumar @ Nirwa be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - III, Banka in connection with Belhar (Khesar) P.S. Case No. 220 of 2017.
