Petitioner apprehends his arrest in Andhra Math P.S. Case No.76 of 2018, registered under Sections 341, 323 and 307 of the Indian Penal Code.
The informant alleged that while he was playing with other children, the petitioner came and asked the informant and others to allow him to play with them but when the informant and other children did not allow the petitioner to play with them on the ground that the petitioner is adult, the petitioner assaulted the informant with his leg on his pelvis region and thereafter put him down on the ground and also assaulted the informant in his abdomen with leg causing rupture of intestine. Learned counsel for the petitioner submits that the informant fell down while he was playing and got injuries but
Patna High Court CR. MISC. No.31003 of 2019(2) dt.09-05-2019 2/2 there is specific allegation against the petitioner that it was the petitioner who assaulted the informant, a child of about 12 years with leg and after putting him down jumped on his abdomen causing intestinal rupture of the informant.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
