2. The petitioner apprehends his arrest in Nirmali P.S. Case No. 117 of 2020, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. As per the prosecution case, informant's husband has left his house along with this petitioner, but he did not return and on the next morning, informant came to know that her husband has been killed with spade, Dabiya etc. Informant suspects that this petitioner and other FIR named accused persons committed the murder of her husband.

4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence and petitioner has been made accused only on suspicion. During investigation, no tangible evidence has come to show complicity of the

5. However, learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that it is a case of 'last seen'. During course of investigation, it has also come that there was animosity between petitioner and the deceased.

6. Considering the nature of accusation, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
