JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-01-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in a case registered for the offence punishable under Section 7 of the Essential Commodities Act. The allegation against the petitioner is of storing and black marketing of LPG cylinder.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is submitted that the petitioner is a poor person and a mechanic of Gas stove and cooker and he was taken into custody on 24.04.2021. Similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 38980/2021.

Having considered the facts and circumstances of the case, let petitioner, above named, be released on bail on

Patna High Court CR. MISC. No.41633 of 2021(2) dt.17-01-2022 2/2 furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Banka in connection with Suiya P.S. Case No.35 of 2021.
