JUSTICE BIRENDRA KUMAR ORAL ORDER 16-12-2019 It appears that the matter arises out of a dispute between a mother and her daughter. The daughter, who is an advocate, had brought this criminal revision application. The parties reached to some consensus. By order dated 17.07.2019, this application was disposed of with liberty to the parties to approach this Court in case there is any departure from the undertaking given by the parties.
Learned counsel for the petitioner appears alongwith a supplementary affidavit stating therein that there is departure from the undertaking given by the parties and the departure has been made by the opposite parties. Copy of supplementary affidavit has not been received by learned counsel for opposite parties saying that since the matter is disposed of, the client has taken away the file.
In my view also, once the petition is finally disposed

No.350 of 2016(14) dt.16-12-2019 2/2 of, the liberty given to the parties to approach this Court in the event of departure from the undertaking given by the parties means a right to the parties to approach through an independent application.
