Petitioner apprehends his arrest in Motipur P.S. Case No.140 of 2019, registered under Sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the informant alleged that the petitioner managed to flee away. Nothing has been recovered from possession of the petitioner. Petitioner does not own any shop in Mirchai Mandi. The recovery was made in between two shops and for that the petitioner has been made accused.

Considering the fact that nothing has been recovered from possession of the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be
