The petitioner apprehends his arrest in Kusheshwar Ashthan P.S. case No. 281/2019 registered u/s 30(a) of the Bihar Prohibition & Excise Act.

The informant got information that one red car was standing near the house of Mukhiya and some persons were dealing in liquor. On such information, raid was conducted. Three persons were apprehended and one person managed to flee away. 60 liter of foreign liquor was recovered from the car. One mobile and one motor cycles were also seized. The learned counsel for the petitioner submits that petitioner was not apprehended on the spot. Nothing has been recovered from the possession of the petitioner. None of the

No.30861 of 2020(3) dt.04-01-2021 2/2 articles seized from the spot belongs to the petitioner but it appears that three persons, who were apprehended from the spot, disclosed the name of the petitioner as the person who managed to flee away from the place of occurrence and 60 liter of foreign liquor was recovered from the car. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
