NILU AGRAWAL ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel appearing on behalf of the Accountant General, Bihar, Patna.

The petitioner superannuated on 30.04.2015 as a Pharmacist from the office of the Respondent no. 4, the Medical Officer-in-charge (M.O.I.C), Primary Health Centre, Ekangarsarai, District- Nalanda.

He submits that all the retiral benefits have been paid to him except the 3rd ACP and the leave salary for the period 14.03.2012 to 28.07.2012.

Counter affidavits have been filed on behalf of the

Patna High Court CWJC No.5589 of 2017(2) dt.19-04-2019 2/2 State and the Accountant General.

Considering the claim made by the petitioner, this writ application is disposed of with a direction to the petitioner to file a detailed representation regarding his dues and the same will be disposed of by the Respondent no. 4, The Medical Officer-in-charge (M.O.I.C), Primary Health Centre, Ekangarsarai, District- Nalanda within a period of three months. Any payment with admissible interest due would be paid within two months thereafter. If certain amounts are inadmissible, the same shall be communicated to the petitioner by a speaking order sent through registered post.
