2. Petitioner is accused in connection with Gogri P.S. Case No. 59 of 2022 registered under Sections 406, 419, 420 and 34 of the Indian Penal Code.
3. It is alleged that this petitioner and co-accused Indrajit Yadav misused and embezzled Government fund during the course of construction of drainage and sewerage from PCC road to the house of Vakil Yadav.
4. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to local village politics. Further submission is that petitioner constructed the work of drainage and sewerage with full satisfaction of the higher authority but with time, due

No.34060 of 2024(2) dt.17-05-2024 2/2 to passing of heavy vehicle in rainy season, some part of the drainage got damaged which has also been repaired by the petitioner as per the instructions of the higher authority. The police after investigation has submitted the charge-sheet. Petitioner is under custody since 02.12.2023.

Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 59 of 2022.
