2. The petitioner is in custody in connection with N.D.P.S. Case No. 27 of 2024, arising out of Sadar P.S. Case No. 41 of 2024, registered for the offences punishable under Sections 401, 414 of the Indian Penal Code and u/s 25(1-b)a, 26, 35 of the Arms Act.

3. As per prosecution case, a country made pistol as well as 29 packets smack (3 grams) and a blue colour TVS motorcycle was recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and nothing has been recovered from the possession of the petitioner. It is further alleged that the recovery is a planted case and he was not

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. In view of the aforesaid facts, submission of learned counsel for the petitioner and also the fact that the petitioner is in custody for more than one year, so I am inclined to release the petitioner on bail.

7. Accordingly, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Special Court-I (NDPS), Muzaffarpur in connection with N.D.P.S. Case No. 27 of 2024, arising out of Sadar P.S. Case No. 41 of 2024, subject to the condition that the petitioner shall remain present physically on each and every date before the trial court.
