This application is filed for grant of regular bail in connection with Kateya P.S. Case No. 117 of 2023 registered under section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that there is recovery of 107.200 litres of country made liquor from a motorcycle. The petitioner is in custody since 18.03.2023 and he has clean antecedent.

Learned A.P.P. has vehemently opposed the prayer for

Patna High Court CR. MISC. No.33467 of 2023(2) dt.23-05-2023 2/2 bail.

Considering the nature of allegations levelled against the petitioner and the fact that he has clean antecedent, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IInd-cum-Special Judge Excise-I, Gopalganj in connection with Kateya P.S. Case No. 117 of 2023.
