JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-07-2019 The case of the petitioner is for payment of deathcum- retirement benefits in view of the death of her husband in harness while discharging his duties as Pump Khalasi under the respondent no.4 in the work charge establishment. The learned counsel for the petitioner submits that now, the Full Bench of this Court has held that even the work charge employees are entitled to death cum retiral dues, as has been held in the case of Mobina Khatoon vs. The State of Bihar & Ors., reported in 2019(1) PLJR 1015.

Having considered the limited prayer of the petitioner, I deem it fit and proper to grant liberty to the petitioner to

Patna High Court CWJC No.4775 of 2017(4) dt.10-07-2019 2/2 approach the respondent no.2 within a period of four weeks from today, whereafter the respondent no.2 shall take a decision, in light of the Full Bench judgment of this Court rendered in the case of Mobina Khatoon (Supra) and pass a reasoned order within a period of eight weeks.
