Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Garkha P.S. Case No. 280 of 2020 lodged under Sections 341, 323, 354, 379, 307, 504, 34 of the I.P.C.
As per the prosecution case, the allegation against the petitioner is that he being the member of mob reached at the house of the informant and started abusing by the order of accused Ashok Kumar Singh. The petitioner has assaulted the informant by iron rod due to which she fell down and bleeding started.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.31993 of 2022(3) dt.06-12-2022 2/2 petitioner has been unnecessary involved in this case. He is a man of clean antecedent and linguishing in judicial custody since 09.04.2022. Charge sheet has already been filed in this case. Counsel submits that the other co-accused has been granted bail by the Co-ordinate Bench of this Court vide order dated 25.01.2022 passed in Cr. Misc. No. 21185 of 2021. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned 12th Additional Sessions Judge, Chapra in connection with Garkha P.S. Case No. 280 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
