The petitioner apprehends his arrest in Belaganj P.S. case No. 365 of 2018 registered under Section 307, 387 and some other Sections of the IPC and u/s 27 of Arms Act. The learned counsel for the petitioner submits that prayer of petitioner for anticipatory bail was earlier rejected vide order dated 25.03.2019 passed in Cr. Misc. No. 16420 of 2019 but thereafter the other co-accused persons have been granted anticipatory bail by coordinate benches of this court in Cr. Misc. Nos. 17095 of 2019 and 17778 of 2019.

Taking into consideration the fact that petitioner has got criminal antecedent also, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is once again rejected.

No.30071 of 2019(2) dt.24-07-2019 2/2 If the petitioner surrenders in the court below, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit taking into consideration the facts that other co-accused persons have already been granted anticipatory bail.
