The petitioner seeks bail in anticipation of his arrest in connection with Kanti (Panapur O.P.) P.S. Case No. 05 of 2018 dated 02.01.2018 instituted for the offences under Sections 341, 323, 354(B), 504, 506 and 34 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act, 2012. The petitioner along with two others is alleged to have eve-teased the girls crossing through that area. Learned counsel appearing for the petitioner has submitted that he is the owner of a shop of general items and some students who normally assembled near the shop of the petitioner have indulged in such activity. The petitioner, in fact, has been named by the informant because of some suspicion in her mind that the action of the students is at the behest of the petitioner.

No.57753 of 2018(2) dt.11-12-2018 2/2 Learned counsel for the petitioner has also drawn the attention of this Court to the two orders passed by the two different benches of this Court in cases of Rahul Singh @ Nitesh Singh @ Nitesh Kumar vs. The State of Bihar (Cr. Misc. No. 37308 of 2018) dated 12.07.2018 and in case of Gunjan Singh @ Gunjan Kumar (Cr. Misc. No. 36695 of 2018) dated 17.07.2018 wherein those persons with similar allegations have been granted anticipatory bail. Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge POCSO, Muzaffarpur in connection with Kanti (Panapur O.P.) P.S. Case No. 05 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
