Mr. None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 06-10-2018 Heard Sri Tribhuwan Narayan, learned counsel for the petitioner. None appeared on behalf of the State. The sole petitioner, who is a lady, apprehending her arrest in Chainpur P.S. Case No. 204 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of her arrest or surrender.
Learned counsel for the petitioner submits that the petitioner has been arrayed as accused in the present case, since she is a registered owner of a motorcycle, from which recovery of about 1.620 ml of Indian Make Foreign Liquor was shown. Learned counsel for the petitioner has also drawn my attention to the statement made in paragraph-3 of the petition to show that petitioner is having clean antecedent.
Considering the nature of accusation as well as the fact that the petitioner is a lady and having clean antecedent, in the event of her arrest or surrender within a period of six weeks
Patna High Court Cr.Misc. No.60457 of 2018(2) dt.06-10-2018 2/2 from today, let the petitioner, namely, Vimla Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge VI-cum- Special Judge (Excise), Kaimur at Bhabua in connection with Chainpur P.S. Case No. 204 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
