JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail in connection with Special Case No. 3639 of 2020 arises out of Danapur P.S. Case No. 314 of 2020 registered for the offence punishable under Section 37 (b) (c) of the Bihar Prohibition and Excise Act, 2018.

Petitioner is the elder brother of the informant. It is alleged against the petitioner that he is an alcoholic and often tortures the family members and invariably comes to the house after consuming liquor. It is evident from the F.I.R. that the allegation against the petitioner is of consuming liquor and not being in trade of liquor. He is in custody since 26.05.2020.

Patna High Court CR. MISC. No.31547 of 2020(2) dt.02-12-2020 2/2 Considering the nature of accusation, this application is allowed. .

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Special Case No. 3639 of 2020 arising out of Danapur P.S. Case No. 314 of 2020.
