====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 13-04-2023 Heard learned counsel for the petitioners.
Learned counsel for the petitioners submits that despite the order by the learned Court below in Miscellaneous Appeal No. 02 of 2016 for taking all efforts for early disposal of the case, there is no progress in the suit.
Learned counsel for the petitioners further submits that this case may be disposed of with direction to the Court concerned for taking steps for expeditious disposal of the suit. Learned counsel for the petitioners also submits that the petitioners are defendant in the suit and they will fully cooperate in the trial Court for early disposal of the suit. Having heard the learned counsel for the petitioners, as prayed for, this case is disposed of with the direction to the learned Court below for taking serious efforts for early disposal of the case as directed by the appellate Court below vide order dated 29.10.2016.
Both the parties are also directed to cooperate in the
Patna High Court C.Misc. No.294 of 2017(6) dt.13-04-2023 3/3 trial Court for early disposal of the suit.
This Civil Miscellaneous application is, accordingly, disposed of with the aforesaid directions.
