The petitioner apprehends his arrest in connection with Industrial Area P.S. Case No. 85 of 2017, registered under Sections 341, 323, 353, 414 of the Indian Penal Code. On the tip of assembling of 3 to 4 criminals at the Hazri Pokhar, informant rushed the aforesaid place and apprehended Sanni Kumar and three accused persons, namely, Amarjeet Paswan, Sintu Kumar and Pappu Paswan managed to escape. Informant also recovered a mobile containing two SIM from the possession of Sanni Kumar. Further it is stated that during course of arrest, Sanni Kumar had created disturbance in discharge of duty.
Patna High Court Cr.Misc. No.55780 of 2018(2) dt.13-12-2018 2/2 It is submitted by learned counsel for the petitioner that petitioner is neither named in the FIR nor was apprehended on spot. His name has surfaced in the confessional statement of co-accused Amarjit Paswan and no offence is made out against the petitioner.
In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hajipur, Vaishali in connection with Industrial Area P.S. Case No. 85 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
