Petitioner seeks regular bail in connection with Dobhi (Sherghati) P.S. Case No. 456 of 2019 registered for the offence under Section 392 of the I.P.C.

The allegation as per the First Information Report is that the Pick Up Van of the informant was over taken by the four unknown persons riding on two motorcycles and they snatched Rs. 1,800/- from the informant.

Learned counsel for the petitioner submits that petitioner is not named in the first information report and his name has transpired on the basis of confessional statement of the co-accused / Munarik Yadav recorded in Sherghati (Dobhi) P.S. Case No. 497 of 2019 and the petitioner has been remanded in this case from Sherghati ( Dobhi) P.S. Case No. 497 of 2019 on 25.11.2019 and since then he is in custody. Learned counsel further submits that he has been granted bail in other cases as

Patna High Court CR. MISC. No.30144 of 2020(2) dt.27-11-2020 2/2 mentioned in paragraph 3 of this bail application. Having regard to the submission made by the parties and taking into consideration the materials available on record and the fact that petitioner is in custody since 25.11.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, District: Gaya in connection with Dobhi (Sherghati) P.S. Case No. 456 of 2019 on the following condition:- (i) that the petitioner shall not repeat offence of similar nature in future.

(ii) that the petitioner shall remain present on each and every date during the course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled. It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
