2. The accused/petitioner seeks bail in connection with Shahpur P.S. Case No. 165 of 2024 (Special POCSO Case No. 251 of 2024) registered for the offences under Sections 363, 366(A), 34 of the I.P.C. and 4/6 of the POCSO Act.

3. The accused/petitioner is not named in the First Information Report and is in custody since 17.07.2024.

4. Allegation against the petitioner is to kidnap the minor daughter of the informant aged about 16 years along

Patna High Court CR. MISC. No.35010 of 2025(4) dt.24-11-2025 2/3 with named co-accused persons.

5. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has been falsely implicated in this case merely on the basis of suspicion. It is submitted that petitioner never came in contact with coaccused Ritik Kumar or the daughter of the informant.

6. Explaining criminal antecedent of the petitioner, it is submitted that petitioner found involved in three more criminal cases, in which he is on bail.

7. While concluding argument, it is submitted that investigation of this case is already concluded, for which charge-sheet has been submitted and as such, there is no chance of tampering with the evidence.

8. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

9. In view of aforesaid factual submission and by taking note of the fact as allegation of elopement and to solemnize marriage with victim daughter of the informant aged about 16 years, is available against co-accused Ritik Kumar, where the allegation to remain present at the time of

No.35010 of 2025(4) dt.24-11-2025 3/3 marriage is available against this petitioner alongwith one Chandan Kumar, who has already bail by one of the learned coordinate Bench of this Court through Cr. Misc. No. 56107 of 2024 dated 23.10.2024, accordingly, above-named petitioner, who is in custody since 17.07.2024, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge (Rape & POCSO Act)-cum-A.D.J.-VIth, Patna/concerned court, in connection with Shahpur P.S. Case No. 165 of 2024 (Special POCSO Case No. 251 of 2024), subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
