A counter affidavit has been filed on behalf of the respondent nos. 1 to 3 wherein it has been submitted that the retiral benefits on the head of Group Insurance, G.P.F. and 90 % of provisional pension has already been paid to the petitioner. It is further submitted that a proceeding under Rule 43b of the Bihar Pension Rules is pending against the petitioner and the petitioner has been asked to furnish pension papers vide letter dated 30.04.2019 for payment of full pension and gratuity.

Patna High Court CWJC No.110 of 2017(9) dt.31-07-2019 2/2 Having considered the submissions made by the learned counsel for the respondents, I deem it fit and proper to dispose off the present writ petition with a direction to the respondent authorities to pay the outstanding amount of retiral dues i.e. 10% of pension and gratuity if payable, within a period of eight weeks of receipt/production of a copy of this order. The writ petition stands disposed off.
