Petitioners apprehend their arrest in Garhpura P.S. Case No.49 of 2020 registered under Sections 323, 341, 504, 506, 427, 354(A), 379, 307 and 34 of the Indian Penal Code. The informant Murari Mahto named three petitioners and others and alleged that Girdhari Mahto assaulted the informant. When the wife of the informant came to save the informant, the accused persons also assaulted her. Learned counsel for the petitioners submits that there is omnibus and general allegation of assault. There is a counter version being Garhpura P.S. Case No.50 of 2020, but from
Patna High Court CR. MISC. No.30862 of 2020(3) dt.15-01-2021 2/2 perusal of the injury reports, it appears that the informant got multiple injuries on his body out of which one injury was found grievous in nature and the wife of the informant got as many as four injuries on different parts of her body, out of which two injuries were found grievous in nature.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
