====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 01-02-2022 Heard Mr. Satrudhan Kumar, learned counsel for the petitioner and Ms. Pushpa Sinha, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Special Case No. 2399/21 arising out of P.R. (Nadi) Case No. 76 of 2021 registered for the offence punishable under Sections 30(a), 32(1), 32(3), 41(1) and 4(2) of the Bihar Prohibition and Excise Act, 2016.

The Excise Officials intercepted a Tempo and recovered 200 litres of illicit foreign liquor from the same and arrested the petitioner from the Tempo.

No.42098 of 2021(2) dt.01-02-2022 2/3 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he was found sitting on the driver seat and was not aware about the illicit liquor being kept by the passenger and/or by its owner. He further submits that the petitioner has got no criminal antecedent and he is in custody since 25.3.2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent, he is in custody since 25.3.2021, charge sheet has already been submitted and the trial is not likely to be concluded in near future due to Covid-19, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with P.R (Nadi) Case

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
