In the present case, the petitioner is challenging the impugned action of the State Bank of India initiated under Section 13 of the SARFESI Act.

Counsel for the State Bank of India submits that the

Patna High Court CWJC No.3581 of 2017(3) dt.21-09-2020 2/2 Bank has already filed an Original Application before the DRT in which the petitioner has already appeared, but this fact has not been brought to the notice of this Court by the petitioner. However, learned counsel for the petitioner, after some argument, seeks permission to withdraw this application with liberty to seek the remedy as available in the law.
