JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-08-2021 Heard learned counsel for the petitioner and learned counsel for the State via video conferencing. The petitioner has renewed his prayer for bail in connection with Barbigha P.S. Case No. 81 of 2019 registered under Sections 392 and 411 of the Indian Penal Code. His prayer for bail was earlier rejected by this Court vide order dated 17.03.2020.

It is submitted by the learned counsel for the petitioner that the petitioner is not named in the FIR. He was arrested during course of investigation on 26.07.2019 and, since then, he is in custody. Till date he has not been put on T.I. parade. He contended that there is no progress in the trial of the case and there is no likelihood of the trial coming to an end in

Learned counsel for the State opposed the application for grant of bail to the petitioner.

Considering the nature of the offence, the submissions made above and the period of over two years undergone by the petitioner in custody, he is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheikhpura in connection with Barbigha P.S. Case No. 81 of 2019.
