JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 366, 372/373 of the Indian Penal Code and section 6 of the Immoral Traffic Act.

As per the prosecution case, petitioner is alleged to have running a brothel in his house from where the daughter of the informant somehow escaped.

Learned counsel for the petitioner denies the allegation. He submits that in 164 Cr. P. C. statement the victim has only taken symbolic name and from that the petitioner has been dragged in the case. No incriminating material has been recovered from the conscious possession of the petitioner. Similarly situated co-accused has already been allowed bail by

Patna High Court CR. MISC. No.41589 of 2021(2) dt.17-01-2022 2/2 a co-ordinate bench of this Court vide paragraph 21 of the bail petition. Petitioner is in custody since 20.4.2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Special Judge, POCSO Act, Begusarai in POCSO Police Station Case No. 37 of 2020/Bakhri Police Station Case No. 01 of 2018.
