JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 The petitioner seeks regular bail in connection with Palasi P.S. Case No. 116 of 2017, registered for offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is of causing death of the deceased.

It has been submitted on behalf of the petitioner that he has been in judicial custody for two years and uptil now only five witnesses have been examined.

Learned counsel for the State opposed the prayer for bail and submitted that there is direct allegation against the petitioner.

Earlier a report with regard to status of trial was called for from the trial court, from which, it appears that the case is

Patna High Court CR. MISC. No.30294 of 2019(3) dt.23-05-2019 2/2 pending for examination of informant, doctor and I.O. and non bailable warrants has been issued against the informant. In such view of the matter, I am not inclined to enlarge the petitioner on bail, however, learned trial court is directed to expedite the trial and conclude the trial as early as possible.

At the same time, Superintendent of Police, Araria is directed to produce the informant and other witnesses in the trial court on the date fixed so that the trial be concluded expeditiously.

With the above observation and direction, this application is dismissed.
