Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Bihar P.S. Case No. 306 of 2021, disclosing offences punishable under Sections 147, 148, 149, 323, 307, 332, 333, 337, 338, 353, 506, 188, 269, 270, 271 of the Indian Penal Code and 27 of Arms Act.

Both the petitioners are in custody since 17.05.2021. It is evident from the F.I.R. that there is general allegation

Patna High Court CR. MISC. No.41050 of 2021(3) dt.05-01-2022 2/2 against persons named therein of committing offence arising out of a land dispute. There are 20 persons named and 22 to 25 not named, who are said to be involved in commission of the offence.

On careful perusal of the First Information Report, I find substance in submissions made on behalf of the petitioner that the allegation is general in nature and there is no specific allegation of commission of any offence against these petitioners who are in custody since 17.05.2021. Considering the facts and circumstances as noted above, this application is allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned C.J.M., Biharsharif, Nalanda in Bihar P.S. Case No. 306 of 2021.
