2. Petitioner seeks regular bail in connection with Buniyadganj P.S. Case No. 267 of 2024, dated 24.10.2024, registered for the offences punishable under Sections 308(5) and 3(5) of the Bharatiya Nyaya Sanhita.

3. The main submissions advanced by petitioner's counsel are that the investigation against the petitioner has been completed, he is presently facing trial and has been languishing in jail since 30.10.2024 the FIR has been registered against unknown persons and contains details of one mobile phone number used to transfer Rs. 4,000/- from the mobile phone number of the victim. However, the said number does not

Patna High Court CR. MISC. No.31951 of 2025(3) dt.13-08-2025 2/2 belong to the petitioner but to one, Chaneshwar Prasad. It is further submitted that one co-accused, Bablu Kumar @ Bhutali Bindas, from whose possession two motorcycles, a mobile phone and cash of Rs. 20,000/- were recovered, has already been granted bail by this Bench vide analogous order dated 12.05.2025 passed in Cr. Misc. No. 9031 of 2025 and the case of the present petitioner stands on better footing from that of the said co-accused.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

5. Considering the aforesaid submissions and mainly the petitioner's custody period and the stage of his trial, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Buniyadganj P.S. Case No. 267 of 2024.
