2. The present application has been preferred for the following relief(s):- (i). To quash and set-aside by issuing an appropriate writ of certiorari the order contained in Annexure-3 dated 28.08.2014 passed in land Dispute Case no.

74/13-14 (Sankar Prasad Singh versus Ram Naresh Pd. and others) by the Learned Deputy Collector, Land Reforms, Barh whereby and whereunder although the dispute raised by the private respondents was not rightly adjudicated upon

Patna High Court CWJC No.13728 of 2015(2) dt.14-07-2025 2/2 between the parties, yet the learned DCLR Barh, wrongly, baseless and illegally disallowed the petition and claim raised by the petitioner and dropped the proceeding and direct to aforesaid claim raised to appropriate forum.

(ii). To issuance of an appropriate writ to appropriate authority i.e.

circle officer Athmalgola to get the land measurement in Khata no.1085, Survey Plot no.413, Area 17.187 Decimal out of the total area 2 acre 72 decimal.

(iii). To issuance of an appropriate writ for directing the appropriate authority to remove the illegal encroach made on the khata no.1085 Survey plot no. 413, areal7.1/2katha.

(iv). Any other relief (s) which the petitioner may be found entitled to in the facts and circumstances of the case.

3. Mr. Rakesh Kumar, learned counsel for the petitioner submits that he may be permitted to withdraw the petition.

4. Accordingly, the same is dismissed as withdrawn.
