The petitioner apprehends his arrest in Bidupur P.S. case No. 46/ 2019 registered under Section 363, 366A of the IPC.

The informant alleged that his sister had gone to attend the call of nature but she did not return. During the course of investigation the informant came to know that this petitioner kidnapped his sister. On enquiry, Gigal Rai and Uday Rai abused and assaulted the informant.

The learned counsel for the petitioner submits that the victim filed Complaint case No. 935/2020 on 09.06.2020. The victim alleged in the complaint petition that since her brother and father were intending to get her married with an old man she left her house and she is living in the house of her relatives.

No.30864 of 2020(4) dt.25-02-2021 2/2 It is submitted that no offence u/s 363, 366A of the IPC is made out against the petitioner but it appears from perusal of the case diary that victim is still traceless. The Investigating Officer made all efforts to search out the victim. There is specific allegation that it was the petitioner who kidnapped the victim. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
