Mr.Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 10-05-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 147, 148, 149, 307, 504, 506, 120(B) of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in brief is that while the petitioner along with his nephew proceeded for his house, in the way, the accused persons intercepted them and accused persons are said to have fired upon the informant, as a result of which, the informant sustained fire arms injury.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 19-01-2019.

Patna High Court CR. MISC. No.31190 of 2019(2) dt.10-05-2019 2/2 Charge sheet has already been submitted. The main allegation is against co-accused namely Kanhaiya Kumar who is alleged to have assaulted the victim. There is no allegation of assault alleged against the petitioner nor any injury is caused by the petitioner. No offence u/S 307 of the Indian Penal Code is made out. Rest of the offences are triable by the Magistrate. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 460 of 2018.
