The petitioner has preferred this application for grant of regular bail in a case registered under sections 120B, 414 and 34 of the Indian Penal Code, sections 30(a), 32 and 41(1) of the Bihar Prohibition and Excise Act, 2016 and sections 25(1-B) (a), 26 and 35 of the Arms Act.

As per the prosecution case, 354. 24 litres of liquor and one country made pistol with two live cartridges were recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. The alleged recovery is from the house belonging to the joint

Patna High Court CR. MISC. No.41401 of 2021(3) dt.18-02-2022 2/2 family. The petitioner is in custody since 27.3.2021 and has no criminal antecedent. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having any criminal antecedent and having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with S. Kamal P.S. Case no. 64 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judgecum-Special Judge, Excise Act, Begusarai. (Partha Sarthy, J) Prakash/- U
