The recovery is of 2 K.G. and 100 grams Ganja and 100 pieces of cigarette containing Ganja filled up from the premises

It has been submitted by the learned counsel for the petitioner that the recovery is between small and commercial quantity and not under commercial quantity. The petitioner was earlier accused in similar nature of offence, but he has been acquitted.

Considering the nature of recovery and the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10, 000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Saharsa in connection with Special Case No. 3 of 2014 arising out of Saharsa P.S. Case No. 193 of 2014 dated 30-3-2014.

The learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions and gets substantially involved in some similar nature of offence.
