JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-07-2024 The present writ petition has been filed seeking the following relief:- "1. That this application is being filed challenging the arbitrary action of the Nagar Parishad, Masaurhi whereby on the private land of the petitioner measuring 2' width and 68' long a common drainage has been constructed by the Nagar Parishad.

The petitioner also prays that after restoration of the land of the petitioner used for the drainage system a further direction be given to construct the drainage system after leaving at least 2' land from the boundary of the petitioner. The petitioner lastly prays

Patna High Court CWJC No.19504 of 2013(3) dt.24-07-2024 2/2 for due compensation for the harassment and arbitrary action of the respondent authority and for any other relief(s) which he is found to be entitled in the facts of this case."

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the Executive Officer, Nagar Parishad, Masaurhi, for redressal of their aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioners approach the Executive Officer, Nagar Parishad, Masaurhi, by filing appropriate representation, within a period of four weeks from today, the same shall be disposed off by passing a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter. 4.

The writ petition stands disposed off on the aforesaid terms.
