2. The petitioners seek regular bail in connection with Paraiya P.S. Case No. 296 of 2025, registered under Sections 103, 3(5) of the B.N.S., 2023.
3. As per prosecution case, the allegation is that on 24.07.2025, the father of the informant had gone to work but did not returned. On 30.07.2025, the dead body was recovered. Thereafter, in CCTV camera the informant saw that eight persons were carrying his father. He alleged that his father was killed by four named persons including the petitioners.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.34045 of 2026(2) dt.19-05-2026 2/3 petitioners are innocent and has falsely been implicated in the present case. Learned counsel further draws attention of this Court to the fact that the occurrence is of 24.07.2025 and the dead body was recovered on 30.07.2025 but the FIR came to be lodged on 17.09.2025 with monumental delay in lodging FIR even after recovery of dead body robs the prosecution of all its authenticity and veracity. Petitioners are in custody since 01.10.2025.
5. Learned APP for the State has vehemently opposes the prayer for bail of the petitioners.
6. Considering the unexplained delay in lodging the FIR and period of custody, this application is allowed.
7. Accordingly, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya Jee /concerned court below in connection with Paraiya P.S. Case No. 296 of 2025.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case
