The petitioner apprehend their arrest in connection with Motihari Town P.S. Case No. 863/2017 registered for the offense punishable under Sections 341/323/354/504/506/509/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the entire allegation against these petitioners is false and fabricated and there is enmity between them from long time and the petitioners and informant are own brothers. It is further submitted that there has been family dispute and a partition case No. 1133 of 2014 has been filed by the own brother of the
Patna High Court CR. MISC. No.33226 of 2019(2) dt.20-05-2019 2/2 informant against the petitioners.
Considering the entire nature of allegations and that the petitioners and informants are closely related family members, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Motihari Town P.S. Case No. 863/2017, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) Saif/- U T
