Mr. Binay Krishna, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-09-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 377 and 34 of the Indian Penal Code, Section 4 of the POCSO Act and Section 3(2)(v) of the SC/ST (POA) Act.

3. As per prosecution case, it is alleged that this petitioner, along with other accused persons, committed unnatural sex with minor son of informant.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case with ulterior

Patna High Court CR. MISC. No.37793 of 2025(3) dt.26-09-2025 2/2 motive. Charge-sheet has already been submitted and petitioner is in custody since 17.03.2025. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other accused persons, committed unnatural sex with minor son of informant. The victim in his statement recorded under Section 164 of the Cr.P.C. has supported the prosecution case.

6. Considering the facts and circumstances of the case, nature of accusation and statement of victim recorded under Section 164 of the Cr.P.C., the prayer for grant of bail to the petitioner is rejected.
