The petitioner apprehends his arrest in Chautarwa P.S. Case No.69 of 2020 registered under Section 30(a) of Bihar Prohibition and Excise Act.
The learned counsel for the petitioner submits that 12 litres country made liquor is said to have been recovered from the mustard field situated near the house of the petitioner and the informant reported that the villagers named the petitioner as the person who had kept the same in the field but the informant did not disclose the name of any villagers.
Taking into consideration the fact that recovery was made from an open field situated near the house of the petitioner and there is nothing to show that the petitioner had kept the liquor in the field and petitioner has got no criminal antecedent,
Patna High Court CR. MISC. No.30447 of 2020(2) dt.16-12-2020 2/2 let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Pawan Kumar Pandey, learned Special Judge, Excise, Bettiah, West Champaran in connection with Chautarwa P.S. Case No.69 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
