JUSTICE BIRENDRA KUMAR ORAL ORDER 02-11-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341,323,324,307,379,504,506/34 of the Indian Penal Code.
Learned counsel for the informant opposed the prayer for bail.
Considering the nature of allegation of assault and injury found by the Doctor on the person of informant vide injury report at Annexure-2, in my view, this is not a fit case, wherein the petitioner should be compelled to go to jail, hence, let the petitioners, above named, in the event of their arrest or surrender before the court below
Patna High Court Cr.Misc. No.59621 of 2018 (2) dt.02-11-2018 2/2 within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Nanpur P.S.Case No. 161 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
