The petitioner seeks bail in Teghra Police Station (for brevity, PS) Case No 366 of 2019 instituted for the offence punishable under Sections 392 of Indian Penal Code. As per the prosecution case, five persons have taken away the pick up van. Three persons, including the petitioner, are said to have been arrested with the pick up van. Learned counsel for the petitioner submits that it is a case of false implication. The petitioner is now in custody since 21.10.2019.

Learned APP points out that there are other case also pending against the petitioner and that the stolen pick up van

Patna High Court CR. MISC. No.30354 of 2020(4) dt.05-01-2021 2/2 has been recovered from his possession.

In view of the aforesaid circumstances, this Court is not inclined to allow the prayer for bail for the moment. The same is rejected.

However, the petitioner would be at liberty to approach this Court for grant of bail after framing of charges. Learned counsel for the petitioner is expected to honour his undertaking given in the instant proceedings today for depositing requisite Court fee and removing the defect (s), as pointed out, when called upon to do so.
