2. The petitioner has prayed for bail in connection with Maner P.S. Case No. 486 of 2023 registered for the offence punishable under Sections 341, 323, 354, 307, 379, 504, 506 and 34 of the Indian Penal Code.
3. The case of the prosecution is that the petitioner has assaulted with iron rod on the head of Ramesh Kumar. It is further alleged that he has assaulted on the whole body of Ramesh Kumar.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He has also submitted that the occurrence is of 26.06.2023
Patna High Court CR. MISC. No.30591 of 2025(2) dt.20-05-2025 2/2 whereas the F.I.R. has been lodged on 29.06.2023. There is delay of 3 days in filing of the F.I.R. The delay has not been explained by the prosecution. From perusal of the order of the trial Court, it transpires that the nature of injury which Ramesh Kumar has received is grievous. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Petitioner is languishing in judicial custody since 25.11.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M 1st Class, Danapur in connection with Maner P.S. Case No. 486 of 2023.
