JUSTICE SHIVAJI PANDEY ORAL ORDER 01-10-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek anticipatory bail in a case instituted for the offences under Sections 420, 467, 468, 471, 504 and 120(B) of the Indian Penal Code.

Allegation has been made that the complainant has given the money on the assurance of granting job. Rs. 14,000/- was deposited to the account of Dhiren Kumar Pal and cash was handed over to the petitioners, they are son and father. Learned counsel for the petitioners undertakes that petitioners would make payment of Rs. 14,000/- to the

Patna High Court Cr.Misc. No.58323 of 2018 (3) dt.01-10-2018 2 /2 complainant and they would further deposit a sum of Rs. 40,000/- in the court below.

If the petitioners would comply with the terms as aforesaid, in that circumstances, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Sivjee Vishwakarma and Sudhir Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate - 1st Class, Muzaffarpur, in connection with Complaint Case no. 617 of 2015, Trial No. 2605 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The amount deposited in the court below will be subject to the result of this case.
