====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-01-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Case No. C2/ 245/2020 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 21.06.2020. He further submits that the allegation made in the F.I.R. that the petitioner was carrying liquor on his head is patently a false story.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like

Patna High Court CR. MISC. No.30578 of 2020(3) dt.12-01-2021 2/2 amount each to the satisfaction of Additional Sessions Judge-IIcum- Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/ 245/2020.

The trial court is directed to expedite the trial and conclude the same in all respect within a period of six months from the date of receipt of this order.

The Superintendent of Police, Sitamarhi is directed to take steps for production of all prosecution witnesses for their examination, so that the trial may be concluded within the time indicated herein above.
