Mr.Dhurjati Kr. Prasad- Gp14 For the Responsent No.13: Mr. Shivendra Kishore, Sr. Adv. For the Respondent No.3: Mr. Surendra Prasad Singh, Adv. ====================================================== CORAM: HONOURABLE MR. JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 14-01-2020 Heard learned counsel for the petitioners as well as learned counsel representing Respondents No. 3, 13 along with GP-14.

Gone through the order impugned.

There happens to be neither any Annexure on the record nor any averment with regard to deposit of renewal fee having after expiry of the license for the financial year 20032004. Although, there happens to be disclosure under Annexure1, that petitioner made a prayer on 16.03.2004, 20.06.2006 and 25.08.2009 for renewal. Even then, there happens to be no disclosure in the aforesaid Annexure-1 that the petitioners have ever deposited required renewal fee. As there was no renewal of license, petitioners were not authorized to continue with the business. If they continued, that was in utter violation of law. Consequent thereupon, there happens to be no requirement to interfere with Annexure-4 over its propriety as the status of the petitioners happens to be in utter violation of law. As such, instant petition is found devoid of merit and is, accordingly, rejected.

Patna High Court CWJC No.3469 of 2017(5) dt.14-01-2020 3/3 In likewise manner, stay so granted vide order dated 12.01.2018 is, hereby, vacated.
