The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 353, 504, 506/34 of the Indian Penal Code.

There is general and omnibus allegation against the petitioner and others of commission of assault. Though there is reference of Police Case bearing registration No.391 of 2017, wherein petitioner is said to be an accused for the offence under Section 135 of the Indian Electricity Act, 2003. However, the F.I.R. of the said case does not reveal that petitioner is accused in that case.

Learned counsel for the Electricity Company

Patna High Court Cr.Misc. No.61379 of 2018(2) dt.19-11-2018 2/2 opposed the prayer for anticipatory bail.

Considering the general and omnibus nature of allegation and the statement of the petitioner on oath that he has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bena (Chandi) Police Station Case No.50 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
