By a detailed order dated 07.11.2014, the DCLR has said that the parties will get their right title and interest decided by a competent civil court. It has been argued by learned senior counsel for the petitioner which cannot be denied by the learned senior counsel appearing for the respondents that once the DCLR held that the jurisdiction of the civil court is there to decide the right title and interest, he cannot have passed any other order with regard to the possession of land etc. by either of the parties.

In that view of the matter, the part of the order of the DCLR with regard to the observations and directions in respect of the possession of the parties is set aside.

Patna High Court CWJC No.14767 of 2015(8) dt.21-09-2022 2/2 So far as the observation that the parties will get their right title and interest decided by the competent civil court, the same is not interfered with.

It has been informed at the Bar that the parties have already filed a civil suit.

With the aforesaid observations and directions, this writ petition is disposed of.
