JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-11-2020 Heard Mr. Abhishek Kumar, learned counsel for the petitioners and Mr. Nawal Kishore Prasad, Additional Public Prosecutor for the state through video conferencing.

2. Petitioners seek regular bail in connection with Ghorasahan (Jharokhar) PS Case No. 115/2020 registered for the offence punishable under Sections 302/34 of the IPC.

3. The allegation, as per First Information Report, is that petitioners along with other accused persons altogether 13 in numbers assaulted the husband of the informant by fists, slaps, kicks and tossed him down on the ground who died while being taken to the hospital.

4. Learned counsel for the petitioners submits that the petitioners are ladies and the entirely family members along

Patna High Court CR. MISC. No.30134 of 2020(2) dt.26-11-2020 2/2 with other relatives of the petitioners have been made accused. Learned counsel further submits that there is general and omnibus allegation against the petitioners and referring to Annexure-2, Postmortem Report, learned counsel submits that no external injury has been found on the person of the deceased.

5. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that there is general and omnibus allegation against the petitioners and they are in custody since 31.03.2020, I am inclined to grant regular bail to the petitioners.

Accordingly, let the petitioners, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sikrahana, Dhaka, East Champaran, in connection with Ghorasahan (Jharokhar) PS Case No. 115/2020.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines of social distancing.
