====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-05-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 149, 448, 341, 323, 307, 379, 504, 506 of the Indian Penal Code.

3. As per the prosecution case, all the F.I.R. named accused persons including these petitioners assaulted the informant by means of sword, farsa and kulhari.

4. It is submitted on behalf of the petitioners that on a petty dispute over taking cattle through the field of the informant, an altercation took place between the parties in

Patna High Court CR. MISC. No.34309 of 2024(2) dt.23-05-2024 2/2 which both sides sustained injuries. Case and counter case. Allegation of assault against the petitioners is general and omnibus. He further submits that injury report does not support the allegations levelled against the petitioners. Petitioners claim clean antecedent.

Considering the backdrop of the case and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jamui in connection with Chandramandi P. S. Case No. 210 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
